Notice of Proposed 80th Percentile Regulation Change in Alaska

Writer's picture: Emily PasternakEmily Pasternak

Please visit the links below for a complete overview of the proposed changes to 3AAC 26.110.

This change would affect all out-of-network provider in Alaska by potentially lowering the allowed amounts for covered services with commercial health insurance plans.

In-network providers would retain their contracted reimbursement rates for services covered by each respective plan.

The Federal No Surprise Act of 2022 requires all out-of-network, non-emergency providers to get consent from their patients to balance bill for their services. The federal waiver providers patients with at least 3 hours or ample notice for patients to change healthcare providers before receiving out-of-network care if they can not afford to be balance billed by the out-of-network provider at the rate(s) disclosed.
